Investment tax in Hungary
Controlled capital-market transactions, adókiegyenlítés, crypto, dividends and szocho - a guide to the 25SZJA

A flat 15% on everything, but three silos that never meet: broker trades net across every account as ellenőrzött tőkepiaci ügylet with a three-year loss credit, crypto is taxed on the year's cash flows rather than coin by coin, and dividends and interest carry a 13% social contribution tax - capped for one, uncapped for the other. The US treaty is gone, ETF distributions are interest, and every forint comes from the MNB rate of the transaction day.

WHAT CHANGED, AND WHAT YOU MUST KNOW

THE US TREATY IS GONE: 30% + 5% + SZOCHO ON US DIVIDENDS

The 1979 US-Hungary double-tax treaty ceased to apply to income from 1 January 2024. A US company now withholds 30% (no W-8BEN treaty rate), and because there is no treaty Hungary credits the foreign tax only down to a 5% floor (Szja tv. 8. § (2); 25SZJA guide row 182). Add 13% szocho - the exemption for EEA-listed shares does not reach NYSE or NASDAQ - and a US dividend loses well over a third. US brokers themselves still qualify for the ETÜ regime through OECD membership (NAV guide footnote 200).

CRYPTO LOSSES CARRY WITHOUT TIME LIMIT FROM THE 2025 RETURN

Act LXXXIII of 2025 rewrote 67/C. § (5)-(7a): a crypto loss declared in any earlier year now counts towards the adókiegyenlítés, capped by the crypto tax of the current and two preceding years, and you must keep a running register of unclaimed losses as a mandatory tájékoztató adat (row 207). Until the 2024 return the two-year window of the ETÜ rule applied. The sheet-06 rows were renumbered with it (24SZJA 206-210 → 25SZJA 206-209), and a new sheet 10 lists every crypto purchase.

SZOCHO ON INTEREST IS PERMANENT - AND HAS NO CAP

The 13% social contribution tax on interest, introduced as an emergency measure on 1 July 2023, was written into the Szocho tv. on 1 August 2024 (1. § (5) f), 36/H. §). It hits broker cash interest, bond coupons and every ETF distribution - which Hungarian law treats as interest, not a dividend - and unlike the szocho on dividends it is not capped by the 24 × minimum-wage ceiling. Only instruments acquired before 1 July 2023 escape it.

Why this is so laborious in practice

  • -A foreign broker is not a kifizető: nothing is withheld, nothing is reported, and NAV's eSZJA draft never contains a single figure from it. You compute and enter everything yourself - and must keep the broker's statement of every transaction of the year, because the ETÜ regime depends on it.
  • -Three silos that never net: ETÜ, árfolyamnyereség and crypto each have their own row, their own loss rule and their own adókiegyenlítés table. A crypto loss cannot shelter a share gain, and outside the ETÜ regime a loss on securities is simply lost.
  • -Crypto is not computed the way any broker statement shows it: 67/C. § pools the year's fiat proceeds against the year's fiat purchases, including coins you did not sell - a lot-by-lot gain report is the wrong number.
  • -Buy and sell are in different currencies on different days: 6. § (1) converts the cost at the purchase date and the proceeds at the sale date, so the forint's movement in between is part of the taxable result.
  • -Two social contribution taxes with different rules: capped for dividends and árfolyamnyereség, uncapped for interest, exempt for EEA-listed shares, and absent from ETÜ and crypto - each on a different row of sheet 09.
  • -A loss is only worth something if it was declared: the adókiegyenlítés works only for losses shown on row 172 (or 164) of the year they arose - forget it once and the credit is gone for good.

67/A. § (3) defines the ETÜ as a transaction in a Bszt. financial instrument (or spot FX) concluded with or through a "befektetési szolgáltató" - a term that expressly includes a person lawfully carrying on the equivalent activity under foreign law - that is supervised in any EEA state, OECD member state or treaty state, provided you hold the provider's statement of every transaction of the year (point bc)). Revolut (Lithuania), IBKR (Ireland), Trading 212 (Cyprus/UK), DEGIRO (Netherlands/Germany), eToro (Cyprus), XTB (Poland), Trade Republic (Germany) and Freedom24 (Cyprus) are all EEA-authorised MiFID firms. NAV's own 25SZJA guide (footnote 200) confirms that even a US broker qualifies in 2025, because the United States is an OECD member.

How the income is computed

67/A. § (1): the income is the excess of "az adóévben elért pénzben elszámolt ügyleti nyereségek együttes összegének" over "az adóévben pénzben elszámolt ügyleti veszteségek és az ügyletkötésekhez kapcsolódó, a befektetési szolgáltató által felszámított díjak együttes összegét". The reverse excess is a loss. It is one figure per taxpayer, across every broker and every instrument - row 172 of sheet 04 (income in column e, the 15% tax in f, a loss in a).

  • Securities (3b): result = (sale value − ancillary costs) − (purchase value + ancillary costs). Commissions on both legs deduct.
  • Cash-settled positions - CFDs, futures, options, FX spot (3c): the closed position's result minus the directly related costs, converted at the closing date.
  • Account, data and custody fees not tied to one trade (3d) reduce the year's aggregate as well.
  • Only closed transactions count: "csak azt az ügyletet lehet tekinteni, amely esetében megtörtént a pénzbeli elszámolás". An open position at year end is nothing.
  • The broker never withholds on an ETÜ (67/A. § (4)); with a foreign broker you determine the income "saját nyilvántartása alapján, az árfolyamnyereségre irányadó szabályokat is értelemszerűen figyelembe véve" (5) b)).

Accumulating ETFs: nothing until you sell

Hungarian law has no deemed-distribution regime - no equivalent of the German Vorabpauschale, the Austrian ausschüttungsgleiche Erträge or the Irish eight-year deemed disposal, and no wealth tax. An accumulating UCITS ETF sold on an exchange through your broker is an ETÜ like any share: 15%, no szocho, losses netted.

The one trap is the exit route. 65. § (1) b) makes the gain on the redemption or transfer of a "kollektív befektetési értékpapír" interest income - except a transfer on a Hungarian, EEA or OECD exchange. So an ETF sold on the exchange is ETÜ, while a mutual-fund unit redeemed with the fund is 65. § interest: 15% plus 13% uncapped szocho if it was acquired on or after 1 July 2023.

Cost basis: no statutory method - FIFO is the practice

Neither 67. § nor 67/A. § prescribes FIFO, LIFO or average cost. For a Hungarian payer broker, 67/A. § (3a) and (4) defer to "az ügyletek elszámolási (párosítási) rendjét" in its business rules; a self-assessing taxpayer must apply the 67. § (9) cost rules consistently. Hungarian brokers and every practitioner guide use FIFO, and Tax-Wizard defaults to it - pooled per instrument across all your accounts - and warns if you pick anything else.

Outside the ETÜ regime a loss has no value in any year

The 25SZJA guide is blunt about 67. §: "Az értékpapír átruházásából származó, árfolyamnyereségnek számító jövedelem nem csökkenthető az adóévben elszenvedett árfolyamveszteség összegével." No netting, no carryforward, and 13% szocho on top. That is why the annual broker statement - the condition of 67/A. § (3) bc) - is worth keeping.

📉 Losses: how the adókiegyenlítés works

A tax credit, not a loss carryforward

67/A. § (6)-(8) turn a declared ETÜ loss into tax already paid. In the return for year N you compute two totals over the window N-2, N-1, N:

Because the window is symmetric, it works in both directions. In a loss year the loss × 15% is set against the ETÜ tax you paid for the two previous years and comes back as a refund in that year's return - a carry-back without amending anything. What is left can be used in the returns of the two following years. A loss older than two years expires; a loss never declared on row 172 a cannot be used at all.

The 2025 return recovers every forint of ETÜ tax paid in 2023 and 2024. The unused 45,000 Ft of loss-tax stays available against ETÜ tax of 2026 and 2027. Tax-Wizard asks for the income, loss and credit of your previous two returns and fills rows 212-220 for you.

Crypto has its own table - and, from 2025, no expiry

Rows 202-209 do the same for crypto, but since Act LXXXIII of 2025 the jogosító összeg counts losses declared in any earlier year (row 207 = all unclaimed earlier losses), while the keret still counts only the crypto tax of the current and two preceding years. The two tables never touch: ETÜ losses cannot offset crypto tax or vice versa, and árfolyamnyereség has no table at all.

The rules behind the table

  • 15% on the gross amount (66. §), converted at the MNB rate of the payment day (6. § (2)). Foreign dividends go on sheet 05 row 182 (gross in b, the tax after credit in c), with the foreign tax on row 189 (treaty state) or 190 (no treaty). No per-country annex - one total per row.
  • Treaty credit: the tax "az egyezmény szerint levonható" - up to the treaty rate - is deducted from the 15%. Withholding above the treaty rate (Germany's 26.375%, Switzerland's 35%) is not creditable and must be reclaimed at source, usually by filing the residence certificate with the broker beforehand.
  • No treaty: the foreign tax is credited, but "legalább 5 százalék adót Magyarországon is fizetnie kell" (guide row 182). Since 1 January 2024 that is the US rule. Refundable foreign tax is never creditable.
  • Szocho 13% (Szocho tv. 1. § (5) b)) up to the 24 × minimum-wage cap - except dividends on a security "az Európai Gazdasági Térség bármely tagállamában működő … szabályozott piacnak minősülő tőzsdére bevezetett" (5. § (3)). Xetra, Euronext, Borsa Italiana and the BSE qualify; NYSE, NASDAQ, the LSE (post-Brexit) and SIX do not. Tax-Wizard uses the issuer's country as the proxy for the listing and flags every exempt line for you to confirm the exchange.
  • ETF distributions are not dividends. 65. § (1) b) calls the yield of a "kollektív befektetési értékpapír" interest, so a UCITS ETF payout is 65. § income - 15%, 13% szocho with no cap, and no EEA exemption (see the interest section). A US-domiciled fund is an alternative investment fund whose yield 66. § (1) a) does treat as a dividend; practitioners disagree, and the report flags both.
  • Return of capital: a capital reduction is 68. § income only above the acquisition cost; a payment the foreign law labels a dividend is osztalék regardless. The report reduces the basis and flags the item.

A US dividend in numbers

100 USD gross, 30 USD withheld, MNB 340 Ft/USD → 34,000 Ft gross on row 182 b. Hungarian PIT would be 5,100 Ft; the credit for the 10,200 Ft withheld is limited so that 1,700 Ft (5%) remains on row 182 c. Szocho: 13% of 34,000 = 4,420 Ft on row 288 (unless your salary already fills the 6,979,200 Ft cap). Effective burden: 30% + 5% + 13% = 48%, or 35% above the cap. The 20 USD withheld beyond the creditable amount is a sunk cost.

Foreign interest is entered on sheet 05 row 183 (gross in b, tax after credit in c) with the foreign tax on row 191 (treaty) or 192 (no treaty, 5% floor). Since 1 January 2024 interest paid by anyone resident in an OECD state is kamatjövedelem even without a treaty (28. § (12)) - the guide says so expressly for the US. Accrued interest you paid on buying a bond deducts from the first coupon received (guide row 170).

The uncapped szocho on interest

Introduced by Government Decree 205/2023 on 1 July 2023 and made permanent on 1 August 2024 (Szocho tv. 1. § (5) f), 36/H. §), the 13% applies to deposit and cash interest for periods after 1 July 2023 and to securities and fund units acquired on or after that date. NAV booklet 49: "A kamatjövedelem … nem számít bele az adófizetési felső határba, vagyis a teljes jövedelem szociális hozzájárulási adóalapot képez." With no Hungarian payer you self-assess it on sheet 09 row 293. Exempt: Hungarian retail government bonds issued after 1 June 2019, real-estate fund units, home-savings accounts.

₿ Crypto-assets

A yearly cash pool, not a lot-by-lot gain

67/C. § (2) recognises a transaction only when you obtain non-crypto value - fiat, goods, a service - by transferring a crypto-asset: "mindaddig, amíg a kriptoeszköz ellenében kriptoeszközt szerez a magánszemély, az ügylet adómentes." Swaps, including into stablecoins, and transfers between your own wallets are nothing.

The year's ügyleti nyereség is the excess of all proceeds of the year's realisations over all documented expenditure of the year on acquiring crypto plus fees - and the 25SZJA guide is explicit that a purchase counts "abban az esetben is ha az adott kriptoeszköz nem került a tárgyévben értékesítésre". The cost of coins bought in an earlier year was deducted then and is not deducted again when you sell them. A year with purchases and no sales is a loss year.

Example - the purchase you did not sell still counts

In 2025 you sell 0.5 BTC bought in 2024 for 25,000 EUR (MNB 400 → 10,000,000 Ft) and buy 1 ETH for 2,000 EUR (800,000 Ft) that you keep. Row 164: proceeds 10,000,000 − costs 800,000 = 9,200,000 Ft income, tax 1,380,000 Ft. The 2024 BTC purchase was a cost of 2024 (declared as a loss then, and usable now through rows 202-209). Sheet 10 lists the ETH purchase with its date, cost and transaction id.

What NAV has not said

There is no published position on staking-as-a-service, on lending interest paid in crypto, on fiat-settled perpetuals or on NFTs. A reward that is consideration for a service (referral, learn-to-earn) may be 67/C. § (4) e) income at receipt rather than a zero-cost lot. Tax-Wizard applies the validation/airdrop reading and flags every reward on the Review sheet.

🤝 P2P lending

65. § is an exhaustive list, and interest on a loan granted by a private individual is not on it - the 25SZJA guide files "a magánszemélytől kapott kamat" under egyéb jövedelem (28. §). Where you owe the szocho yourself and nobody reimburses it, 29. § makes 89% of the income the tax base: row 19 of sheet A carries the revenue in b, costs in c and 89% of the difference in d, and the 13% szocho goes on sheet 09 row 293.

Platforms that issue publicly offered notes (Mintos "Notes" under a Latvian prospectus) can be argued to be 65. § (1) b) securities whose yield is interest - 15% and 13% on the full amount instead of on 89%, on row 183. NAV has issued no guidance on P2P platforms; Tax-Wizard defaults to egyéb jövedelem and offers the interest treatment as a setting. Written-off principal is never deductible under either reading.

MNB fixes at 11:00 on Hungarian business days and each rate is valid until the next publication, so a weekend, holiday or bridge day resolves to the last published rate. Tax-Wizard ships the full MNB series and refreshes it from the bank's own service.

The cap ("adófizetési felső határ", Szocho tv. 2. § (2)) is 6,403,200 Ft for 2024, 6,979,200 Ft for 2025 and 7,747,200 Ft for 2026. It is filled first by your consolidated-base income - salary, self-employment, egyéb jövedelem - and only what is left is charged on dividends and árfolyamnyereség. NAV's own example: salary 3,790,000 Ft and árfolyamnyereség 5,000,000 Ft → szocho base 3,189,200 Ft, tax 414,596 Ft. Enter your other income in the panel; left at zero, the report charges the full 13%.

Worked examples

1. A share bought in dollars and sold in euros

10 AAPL bought on 2 January 2024 for 1,500 USD plus 5 USD commission (MNB 350) → cost 526,750 Ft. Sold on 30 June 2025 for 2,000 EUR less 4 EUR commission (MNB 400) → proceeds 798,400 Ft. ETÜ result +271,650 Ft. The forint's move against both currencies is inside that number - there is no separate FX gain.

2. Netting across a losing trade and an option

The same year: TSLA sold at −182,000 Ft, an ETF at +200,000 Ft, a bond at +40,000 Ft, and an S&P option closed at −800 USD (MNB 340 on the closing day → −272,000 Ft). Row 172: 271,650 − 182,000 + 200,000 + 40,000 − 272,000 = 57,650 Ft income, tax 8,648 Ft, no szocho. Under 67. § instead, the two losses would vanish, 511,650 Ft would be taxed at 15% and bear 13% szocho.

3. A German dividend and an Irish ETF distribution

SAP pays 200 EUR with 52.75 EUR withheld (MNB 400): 80,000 Ft on row 182 b, credit capped at the 15% treaty rate = 12,000 Ft, Hungarian tax 0, the 9,100 Ft excess reclaimable in Germany, szocho exempt (Xetra). VWRL distributes 50 EUR: 20,000 Ft of interest on row 183 - 3,000 Ft PIT and 2,600 Ft uncapped szocho on row 293.

4. Mintos interest

300 EUR of P2P interest (MNB 400) = 120,000 Ft on row 19 b; the base in column d is 89% = 106,800 Ft; PIT 16,020 Ft; szocho 13,884 Ft on row 293. Treated as 65. § interest instead, the base would be the full 120,000 Ft.

The 24SZJA used the same rows except two things: sheet-04 income and tax sat in columns d/e, and the crypto block ran 206-210. Tax-Wizard's workbook carries the right numbering for the year you select.

The draft contains only what Hungarian payers reported. You complete it in eSZJA row by row (or in ÁNYK until its sunset on 31 December 2026), attach nothing, and keep the broker statements for the five-year limitation period. NAV does receive CRS bank data from abroad and queries mismatches - the absence of prefill is not an absence of visibility.

No e-file from Tax-Wizard - by design

Does my Revolut / IBKR / Trading 212 account qualify as ellenőrzött tőkepiaci ügylet?

Yes, provided you hold the broker's statement of every transaction of the year. 67/A. § (3) b) covers any investment firm supervised in an EEA, OECD or treaty state, and expressly includes firms operating under foreign law; all supported brokers are EEA-authorised, and NAV's guide confirms a US broker qualifies through OECD membership.

Can a crypto loss offset a share gain?

No. ETÜ (67/A. §), árfolyamnyereség (67. §) and crypto (67/C. §) are separate silos with separate rows and separate adókiegyenlítés tables - rows 212-220 for ETÜ, 202-209 for crypto, none for árfolyamnyereség. A loss in one never reduces tax in another.

Are accumulating ETFs taxed every year?

No. Hungary has no deemed-distribution regime and no wealth tax. An accumulating ETF sold on an exchange through your broker is an ETÜ taxed only on sale. A distributing ETF's payout, however, is interest under 65. § (1) b) - 15% plus uncapped 13% szocho.

Is swapping one crypto for another taxable?

No. 67/C. § (2) recognises a transaction only when you receive non-crypto value; NAV's guide: "mindaddig, amíg a kriptoeszköz ellenében kriptoeszközt szerez a magánszemély, az ügylet adómentes." Swaps into stablecoins are equally neutral. Paying for goods or services with crypto is a realisation.

Why do I still pay tax on a US dividend that was withheld at 30%?

Because the US-Hungary treaty ceased to apply on 1 January 2024. Without a treaty Hungary credits the foreign tax only down to a 5% floor, and 13% szocho applies because the EEA-listing exemption does not reach US exchanges. The 30% itself cannot be reduced by a W-8BEN any more.

Which exchange rate do I use?

The MNB official rate in force on the day of each item - the purchase for the cost, the sale for the proceeds, the closing day for a derivative (Szja tv. 6. § (1)). You may elect the rate of the 15th of the previous month instead. If your broker converted the currency inside the trade, the rate it applied governs (6. § (3) b)).

How much szocho do I pay on dividends?

13%, but only until your consolidated-base income plus dividends and árfolyamnyereség reach 24 × the minimum wage - 6,979,200 Ft in 2025, 7,747,200 Ft in 2026. A salary above that figure means zero szocho on dividends. Dividends on shares listed on an EEA regulated market bear none at all; interest is charged without any cap.

Will any of this be in my eSZJA draft?

No. The draft is built from data reported by Hungarian payers; a foreign broker is not one. Every ETÜ, dividend, interest and crypto figure must be added by you, row by row, by 20 May - and the tax paid by the same date.
