Irish CGT is due 15 December — not when you file

Ireland splits paying capital gains tax from filing the return. Tax on everything you sold between 1 January and 30 November is due on 15 December of that same year. The return covering those disposals is not due until 31 October of the following year — more than ten months later.

That gap is why people miss it. Nothing prompts you: no return is outstanding, no broker sends a demand, and Revenue does not issue a bill. You are expected to work the figure out and pay it.

The two payment windows

The window is defined by the disposal date, not the settlement date and not when the cash reached your bank. A sale executed on 28 November that settles in December still belongs to the 15 December payment.

What you need to work out before 15 December

  • Net chargeable gains for the year so far — gains less allowable losses on disposals from 1 January to 30 November.
  • The €1,270 annual exemption. Personal, not transferable between spouses, and not carried forward. Unused, it is gone on 31 December.
  • Losses brought forward from earlier years, which carry forward indefinitely in Ireland.
  • 33% on the balance. Development land and certain other assets differ; ordinary shares, ETFs taxed under CGT, and crypto are all 33%.

The multi-broker trap. Each broker only knows its own account. If you sold at a gain on one platform and at a loss on another, neither statement shows your net position, and the €1,270 exemption applies once across all of them — not once per broker.

The four-week rule catches December repurchases

Section 581 TCA 1997: if you sell shares at a loss and buy the same shares back within four weeks, that loss is restricted — it can only be set against gains on the same class of shares, not against your other gains.

This matters in December specifically, because selling at a loss to reduce the 15 December payment and then rebuying in early January falls inside the window. And critically: the rule follows the taxpayer, not the account. Selling on one broker and repurchasing on another does not avoid it, and neither broker can see the other half of the pair.

The charge that arrives without a sale

Separate from CGT, Irish funds and ETFs are subject to a deemed disposal every eight years (s.739E TCA 1997). On each eighth anniversary of buying a holding, you are treated as having sold and immediately repurchased it at market value, and exit tax falls due on the gain — whether or not you sold anything.

Nothing announces it. No contract note is generated, no broker statement flags it, and the anniversary is per purchase, so a portfolio built up over years has them scattered across the calendar. Someone who bought in March 2019 has one falling due in March 2027.

Tax-Wizard now works these out from your open positions, dates each one, and values it where a price is available for that anniversary.

How to pay

  1. Sign in to ROS (or myAccount if you are a PAYE taxpayer without a ROS certificate).
  2. Choose the CGT payment for the correct period — the initial period (Jan–Nov) or the later period (December).
  3. Enter the amount you calculated and pay by card or debit instruction.
  4. Keep the workings. The return you file the following 31 October must agree with what you paid.

Paying an estimate is better than paying nothing: interest runs on late CGT from the due date, even though the return is not yet outstanding.

Working out the number

Upload your broker files and Tax-Wizard matches disposals on a FIFO basis, applies the €1,270 exemption and your carried-forward losses, and produces a Form CG1 / Form 11 ready report. It also flags the two things a single broker statement cannot show you: cross-broker four-week rule conflicts, and upcoming eight-year deemed disposals.
